DigiZilla Pro respects the intellectual property rights of creators and content owners worldwide. We maintain a zero-tolerance policy against willful copyright infringement.
1. Notice & Takedown Procedure
If you believe that your copyrighted work is being infringed by material hosted on DigiZilla Pro cloud servers, VPS infrastructure, or client websites, please submit a written DMCA notice to our designated abuse agent containing all required legal elements under 17 U.S.C. § 512(c)(3).
2. DMCA Notification Requirements Checklist
To enable swift investigation and legal validity, your formal notice must include:
- Identification of the Work: A clear description or direct link to the original copyrighted work claimed to be infringed.
- Identification of Infringing Material: The exact URL(s) or server hostnames where the infringing material is located on our platform.
- Contact Information: Your full legal name, physical address, telephone number, and valid email address.
- Good Faith Statement: A statement that you have a good faith belief that disputed use of the material is not authorized by the copyright owner, its agent, or the law.
- Accuracy Statement under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right infringed.
- Signature: A physical or verifiable electronic signature of the copyright owner or authorized representative.
3. Investigation & Expeditious Action
Upon receiving a bona fide notification that meets statutory requirements, our abuse desk will:
- Acknowledge receipt of the complaint within 24 to 48 business hours.
- Promptly remove or disable access to the infringing material.
- Notify the affected subscriber/customer with a copy of the takedown notice.
4. Counter-Notification Procedure
If a customer believes their material was removed or disabled as a result of mistake or misidentification, they may file a written Counter-Notification under 17 U.S.C. § 512(g). The counter-notice must state consent to federal jurisdiction and be signed under penalty of perjury. Upon receiving a valid counter-notice, DigiZilla Pro will forward it to the original complainant. The material may be restored within 10 to 14 business days unless the copyright owner files a court action seeking an injunction.
5. Repeat Infringer Policy
In accordance with the DMCA and industry standards, DigiZilla Pro maintains an automated tracking policy for repeat copyright infringements. Subscribers or account holders who repeatedly violate intellectual property rights will face immediate service suspension, domain revocation, and permanent account termination.
